mySOP Engage Website (“Website”) and mySOP Engage Platform (“Platform”) is provided and maintained by Sydney Olympic Park Authority (“SOPA”, also “our”, we”). The software platform is owned by Social Pinpoint Pty Ltd and operated by us, Sydney Olympic Park Authority.
Terms and conditions of using mySOP Engage
You (which means an individual, partnership or any body or person whether incorporated or not) accept and acknowledge this the disclaimer and all terms and conditions set out in these Terms of Use (“Terms of Use”) and our Privacy Policy https://www.dpie.nsw.gov.au/privacy (“Privacy Policy”) apply to your use of and access to our Website and Platform. You agree to comply with these Terms of Use and any applicable laws and regulations when using or accessing the Website and Platform.
References to Website and Platform in these Terms of Use include the accessibility, form and Content contained in the Website and Platform unless otherwise stated in these Terms of Use.
Our Terms of Use and Privacy Policy may vary from time to time and you agree that we may update the Content, form and nature of the Platform, including these Terms of Use at any time, without notice to you. These Terms of Use survive termination of your Login.
1. When you access and use the Platform
You must register / join to obtain an account to Login to the Platform using a Username and password (“Login”). You must keep the Login secure and not give your Login to anyone. At our absolute discretion, we will issue a Login or terminate your Login (such termination which can occur without notice).
You warrant that you are over the age of 18 years if you register to obtain a Login.
2. Your use of the Website and Platform and its Content
You may not commercialise, pass off, adapt, print, reproduce, publish or store any services, products or information described on, or provided in our Website or Platform whether the Content is created by SOPA or a User (“Content”), unless you have obtained our prior written consent (if we are the owner of the Content) or the written consent of the owner in the copyright in that Content.
You acknowledge that Content is available to any User of the Website and Platform (“User”). Any Content you make available on the Website and Platform must not be confidential information and must comply with these Terms of Use.

If you upload Content you are responsible to obtain consent of the person photographed in any photograph, and to ensure that you obtained prior consent of the parents and/or guardians of a child for the taking and use of that photograph if the person photographed is not under the age of 18.

4. Linking to the Website and Platform
You may establish an external direct Link to the landing page of the Website at www.mysop.com.au/engage from an external Website (“Link”), at all times displaying the correct URL in a new window and not in a browser or a frame within your own Website. The correct name for the Website is “mySOP Engage”.
You must ensure the Link complies with, and does not breach our Copyright Notice and you must not Link the Arms, symbols and emblems, logos and trademarks of the State of NSW, or imply or provide endorsement of your product, views, services, person or organisation by SOPA.
The Link must not Link to a Website that contains offensive, distasteful or illegal Content. If we direct you to, you must remove a Link immediately.
5. Disclaimer about the Website and Platform
You must exercise care and your own discretion when you use the Website and Platform. We do not guarantee, represent or warrant the accuracy, availability, completeness or currency, accessibility, quality or operability of the Website, Platform, Content or any Third Party Link. We do not guarantee the Website, Platform or any Third Party Link is secure or free from computer viruses or security risks. The Website and Platform may contain names and images of Aboriginal or Torres Strait Islander people who are now deceased.
7. Moderation Rules
You agree that you will only use the Platform for making Content available that is suited to to the purpose of mySOP Engage which is community engagement to help shape Sydney Olympic Park as a place and community.
You will be respectful of others in your conduct and Content which must not be offensive, harassing, abusive, defamatory, threatening, anti-competitive or illegal or breach these Terms of Use. You will not use the Website or Platform to stalk or defame any User or anyone or anything else. Please refer to the mySOP Engage Moderation Policy.
SOPA does not guarantee it will actively monitor Content on the Platform. In the event any Content is made available on the Platform that does not comply with these Terms of Use that is brought to the attention of SOPA, it will take action at its discretion including (but is not limited to) directly contacting the User to request immediate deletion of the Content or terminating the User’s access to the Platform. If you consider any Content or User conduct has breached these Terms of Use please tell us using the feedback details provided in these Terms of Use.
8. Intellectual Property
Our Copyright Notice https://www.sopa.nsw.gov.au/en/Copyright applies to your use of and access to the Website and Platform.
SOPA reserves the right to all other intellectual property the processes and technologies which form part of this Website and Platform and are not explicitly licensed. SOPA doesn’t warrant that any Content made available on the Platform by a User, or on a Third Party Link doesn’t infringe third party intellectual property rights.
If you upload Content you are warranting that, and are responsible to ensure, that the Content does not infringe any third party intellectual property rights (including any copyright) and that you have obtained full permissions and consent to use and grant the licence for the Content specified in this item 8 of these Terms of Use if you are not the owner of intellectual property rights (including copyright) in the Content.

We may notify you from time to time with Notifications by email of activity related to your Login and various activities within the Platform such as receiving Notifications of votes or comments about Content you make available (“Notifications”).
